Train VB LLC – TERMS & CONDITIONS

By purchasing services, participating in training sessions, using our website, using our facility, or attending any Train VB LLC events, you are agreeing to the following Terms & Conditions. Please read carefully before proceeding.

SERVICES

Train VB LLC provides fitness coaching, private training, semi-private training, group training, studio rental, and related wellness services, including digital and online coaching.

ELIGIBILITY

You must register on our website and complete all required forms prior to participation.

You must be medically cleared for all fitness-related activity prior to your first session.

Participants under the age of 18 must have a parent or legal guardian complete all required forms and provide written consent prior to participation.

Train VB LLC reserves the right to deny or discontinue services to any individual if participation is deemed unsafe, or for any other reason, at our sole discretion.

MEMBERSHIPS & PACKAGES

Recurring training packages are billed automatically on a monthly basis unless cancelled in accordance with our Cancellation Policy below.

Clients are responsible for maintaining a valid payment method on file at all times.

Unused, missed, or cancelled sessions are non-transferable and non-refundable unless approved at the sole discretion of Train VB LLC.

Makeup sessions are not guaranteed.

PAYMENT POLICY

Payment is due before services are rendered.

Late or failed payments may result in suspended access to services and the facility until the outstanding balance is resolved.

Prices are subject to change with reasonable advance notice to clients.

All sales are final.

CANCELLATIONS & RESCHEDULING

Clients:

Clients must provide at least 24 hours’ notice to cancel or reschedule a session. Sessions cancelled with less than 24 hours’ notice will be forfeited without refund.

Cancellation of a recurring package requires written notice submitted to Train VB LLC at least 10 days before the next scheduled billing date. Cancellation requests received after this window will take effect the following billing cycle.

Refunds will not be issued for cancelled sessions or unused portions of packages.

Makeup sessions are not guaranteed.

Trainers Renting Space:

Trainers renting our space are responsible for paying for all agreed-upon hours regardless of their ability to fill their designated time slot(s).

Trainers must provide a minimum of 10 days’ written notice prior to their next automated billing cycle to cancel or update their designated rental hours. Failure to provide timely notice will result in the trainer remaining responsible for the upcoming billing cycle.

Trainers may only use the specific area designated to them by Train VB LLC and only during their reserved time slot(s). Use of the facility outside of these parameters is a violation of the rental agreement and may result in immediate cancellation of rental privileges.

Train VB LLC reserves the right to reschedule trainers, classes, appointments, and other reservations as needed.

REFUND POLICY

All fees, including training packages, session purchases, digital products, rental hours, and any other products or services, are non-refundable.

Exceptions may be made at the sole discretion of Train VB LLC on a case-by-case basis.

ASSUMPTION OF RISK

Participation in fitness activities involves inherent risks, including but not limited to:

Muscle strain, sprains, or tears

Falls and impact injuries

Joint or skeletal injury

Overexertion or dehydration

Cardiovascular and heart-related events

Equipment malfunction

Injury related to pre-existing physical conditions

MEDICAL DISCLAIMER & EMERGENCY CONSENT

Train VB LLC is not a medical provider. Any fitness, nutrition, or wellness guidance provided is for educational purposes only and does not constitute medical advice.

Clients should consult a licensed physician prior to beginning any exercise program.

By participating, you consent to emergency medical treatment in the event of an injury or medical emergency. You acknowledge that Train VB LLC staff will contact 911 in any such situation.

Train VB LLC maintains a working Automated External Defibrillator (AED) on the premises for emergency use.

INDEMNIFICATION & LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, clients and trainers agree to indemnify and hold harmless Train VB LLC, Old Great Neck Road LLC, their owners, employees, contractors, and affiliates from any and all claims, damages, losses, or liabilities arising from their voluntary participation in services or use of the facility, including claims arising from their own negligence or voluntary assumption of risk.

TRAINERS RENTING SPACE

By renting space at Train VB LLC, you agree to:

Use all equipment only for its designated purposes and in a safe and responsible manner.

Access the facility only during the times specified in your rental agreement.

Require all clients to register with Train VB LLC prior to entering the facility.

Maintain a current liability insurance policy that covers you and any individual you bring into the facility. A certificate of liability insurance naming Train VB LLC as an additional insured must be provided prior to your first scheduled time slot and kept current throughout the rental term.

Comply with all Train VB LLC rules, policies, and procedures at all times.

PHOTOGRAPHY & MEDIA RELEASE

Train VB LLC may photograph or record video during sessions and events and may use such content for marketing, promotional, and social media purposes. Clients who do not wish to appear in marketing materials must submit a written opt-out request to [email protected] prior to their first session. This request will be documented and honored on an ongoing basis.

CODE OF CONDUCT

All clients and trainers are expected to:

Treat all staff, trainers, and members with respect.

Follow all safety instructions provided by Train VB LLC staff.

Use equipment responsibly and only for its designated purposes.

Maintain appropriate conduct on the premises and in all communications with Train VB LLC.

Train VB LLC reserves the right to immediately terminate services for inappropriate, unsafe, or harmful behavior without refund.

INTELLECTUAL PROPERTY

All Train VB LLC programming, branding, workout plans, videos, and content are the exclusive property of Train VB LLC and may not be copied, distributed, shared, or resold without prior written permission.

WEBSITE & ONLINE USE

Users of the Train VB LLC website agree not to copy, reproduce, or distribute any website content without written permission and agree not to use the website for any unlawful purpose.

PRIVACY

Personal information collected by Train VB LLC — including name, contact information, payment information, and health information — is used solely for business operations, including scheduling, communication, payment processing, and analytics. Train VB LLC does not sell personal information to third parties. Data may be shared with trusted third-party service providers (such as payment processors or scheduling platforms) solely as necessary to operate our business. Clients may request review or deletion of their personal information by contacting [email protected].

DISPUTE RESOLUTION

Any dispute arising from these Terms & Conditions shall first be submitted to good-faith mediation before initiating formal legal proceedings. In the event mediation is unsuccessful, any legal proceedings shall be governed by the laws of the Commonwealth of Virginia and shall be brought exclusively in a court of competent jurisdiction located in Virginia Beach, Virginia.

GOVERNING LAW

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia.

MODIFICATIONS

Train VB LLC reserves the right to update or modify these Terms & Conditions at any time. Continued use of our services following notice of any changes constitutes acceptance of the revised Terms & Conditions.
